Terms of Service

These Terms of Service ("Terms") govern your access to and use of the POSTED mobile application and website at postedlabs.io (the "Service"), operated by PostedLabs, Inc. ("POSTED", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To access the Service, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

POSTED provides tools for managing and publishing content to third-party social media platforms. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

Use the Service to publish content that violates any applicable law or the terms of service of any connected social media platform
Use the Service to send spam, unsolicited messages, or engage in abusive behavior
Attempt to gain unauthorized access to any part of the Service or its related systems
Reverse engineer, decompile, or attempt to extract source code from the Service
Use the Service to infringe on intellectual property rights of any third party
Use the Service for any fraudulent, deceptive, or misleading purpose
Interfere with or disrupt the integrity or performance of the Service

4. Connected Social Media Accounts

The Service allows you to connect and manage third-party social media accounts. By connecting an account, you:

Authorize POSTED to access and act on your behalf on those platforms as permitted by the relevant platform APIs
Confirm that you have the right and authority to manage the connected accounts
Acknowledge that your use of connected platforms remains subject to those platforms' own terms of service
Accept sole responsibility for all content published through the Service to connected accounts

We are not responsible for actions taken by third-party platforms, including suspension of accounts or changes to API access.

5. Your Content

You retain ownership of all content you create, upload, or publish through the Service ("Your Content"). By using the Service, you grant POSTED a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely for the purpose of providing the Service.

You represent and warrant that Your Content does not violate any law or third-party rights, including copyright, trademark, privacy, or defamation.

6. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription fees are billed in advance and are non-refundable except as required by law or as stated in our refund policy.

We reserve the right to change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

7. Free Trial

We may offer a free trial period for certain subscription plans. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. We will notify you before your trial expires.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by PostedLabs, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express written permission.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTEDLABS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold POSTED, its officers, directors, employees, and agents harmless from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time by contacting us at support@postedlabs.io.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the new Terms.
